When to use

  • You are hiring a permanent or ongoing full-time or part-time employee.
  • You want to replace an existing employment agreement that does not reflect current law.
  • You need an agreement that satisfies mandatory requirements under the ERA 2000 without needing to start from scratch.

When NOT to use this document:

  • The employee will be on a fixed-term contract or genuinely casual arrangement – use the framewrk Fixed-Term and Casual Employment Agreement instead.
  • The employee is in a highly specialised or regulated role such as healthcare, education, or financial services – additional sector-specific provisions may be required.
  • You are engaging a contractor rather than an employee – use the framewrk Independent Contractor Agreement instead.

Product description

Every employee in New Zealand must have a written employment agreement before they start work. That is not optional. An employer who fails to provide one is in breach of the Employment Relations Act 2000 and is exposed to penalties and employees who have no documented obligations.

But having any agreement is not enough. An employment agreement that is missing mandatory provisions, contains incorrect minimum entitlements, or does not reflect current law can create as many problems as having none at all.

The agreement covers:

  • Trial period – optional 90 day trial period, available to all employers regardless of size
  • Hours of work – agreed hours and location
  • Rest and meal breaks – the full three tier entitlement under the ERA 2000
  • Remuneration – a total remuneration structure covering base salary, KiwiSaver, and other components
  • Leave entitlements – annual leave, sick leave, bereavement leave, and public holidays
  • Confidentiality – protecting business information during and after employment
  • Intellectual property – assignment of work product to the employer
  • Restraint of trade – optional clause with fields for duration and geography
  • Garden leave – optional garden leave provision during the notice period
  • Termination and notice – notice periods and summary dismissal provisions, with an expanded serious misconduct definition reflecting ERA 2026 contributory conduct changes
  • Personal grievances – mandatory plain language explanation of problem resolution services
  • KiwiSaver – employer contribution options
